About Mrs. Cherry Blossom

Remember her below?

When I blogged about how insanely similar I looked like her at that moment, well I still do, because my invitations are painfully killing me slowly. But I wanted to share one of the humps that I had to get through when Monster Crayons, my previous videographer, dissolved their business with a nice apologetic letter and a promise of refund.

But guess what? I never got that money back from them … shocked026

I gave them the benefit of the doubt and respected their distress with the dissolution of their business. I emailed back a couple times to follow up and attempted to contact them via phone with no response. You can understand my slight increase in panic.

I checked in with my friends who got married late last year that I had referred to Monster Crayons. One friend got their video as promised, but they weren’t too happy with the quality they received. Another friend was upset because they missed her ceremony; she received her video but with a lot of important moments that were filmed but not included, and was given a refund with no follow-up as well. You can imagine how bad I felt because I had referred my friends for their once-in-a-lifetime experience.

Miss Penguin then notified me of more brides that were in similar situations on The Knot Boards. There were brides who had not received their product or deposit money like me as well. We all tried to try to contact Monster Crayons via phone (I’m talking every other day) and email time and time again, but yet no return phone calls. It became increasingly worrisome.

Action needed to be taken and pronto! I was out a lot of money and I was not having it. I couldn’t freak out and cry and scream, so I just had to take a ….

Plan of action:

  • I contacted brides that were in the same situation as myself and asked them how they were dealing.
  • I contacted PayPal, which would not consider my dispute because it was past the 45 day period for dispute.
  • Next I contacted 7 on your side and started a thread to advise other brides to do the same so that it could draw attention to our case, and spread the awareness that it was a large pool of brides affected.
  • Last, I contacted my credit card company to file a dispute.

Advice:

1.) Make sure to keep all documentation: electronic and hard copies

  • Emails: I have my emails grouped by vendors so that I can easily pull up any and all conversations we’ve ever had
  • Contracts: Everything MUST be in writing. Every vendor I am working with, I have requested some sort of documentation. Whether it be confirmation via email or a hard-copy signed terms and agreement contract
  • Receipts: Every payment I’ve made, I’ve printed and stored in my binder chronologically

2.) Try to make payments with your credit cards instead of cash/check

  • Not all vendors accept credit cards. If they don’t, pay with a check so that you have hard copy documentation along with your contract that clearly states that payment was received and paid.
    • I’ve taken to printing a copy of the check after it had been cashed to serve as additional form of receipt of payment as well.

It is not exactly green, but I have printed all of the above in hard copy form, just in case I don’t have access to a computer or something goes wrong, I have everything I need within reach.

The conclusion: Because of all my extensive documentation, which really helped my case, I was able to file a dispute in writing and receive a refund from my credit card company! Although the letter (which I know is standard) said that I was granted credit, if my case is somehow proved invalid, they’ll rescind the credit.

Lesson learned. A little hump hopped over. Hope you won’t have to go through the same.

Anyone else deal with a similar situation? What advice do you have for other brides?

it SUCKED that you had to go through that mah #2. Credit Card payments really seem to save everyone’s butts (not to mention all the points you get for using it!!!) I’m so happy that the issue was resolved for you, however it looks like Monster Crayons got away with a bunch of money…which I assume the Credit Card will just take from them anyway, so thats good. I feel horrible for brides that haven’t received their tapes. Thats the worst part of this :(

I am so glad you got your money back! Those are some excellent tips for keeping things organized. I am good about saving emails but you’re right about also having hard copies.

I am going through this with my photographer. he stopped returning calls and email was turned off. I was referred by a friend who liked his product and she even went out to his studio to talk to him and everything is gone except the sign outside and a desk and phone. So, I am out a deposit and one month from my wedding having to scramble for a new photographer that I like and that is available on my date. So, I pulled my hair out too. I’m glad to hear that you did get it back.

Make sure that when you get a contract from your vendor that it is signed by both you and the vendor. With one of my vendors, there was no space for them to sign but I insisted that they sign and date the contract somewhere in case the worst case scenario happens and they try to argue that they never entered into a contract because they didn’t sign it.

Hi Ms. CB! Oh don’t feel bad for the referrals. It is not your fault that their company is a flake. Yeah they missed my whole ceremony. =…( And though I received a refund, I still have NOT gotten back any videos yet, not even a clip!!!! and my wedding was last September! I also have not heard back from them at all. Should we start looking into some legal action???

That is just horrible. Thank goodness you were able to get your credit, but I feel horribly for those poor brides who lost out on the only (moving) memories from their day. A photographer in my area recently did that, and I received TEN extra engagement/wedding bookings from his business closure, and as an apology of sorts, the company with the closed doors forwarded us about 10 percent of the deposits, which I awarded to the brides equally as well as a discount.

I figure its work I would not have received otherwise, and the gentleman is actually being prosecuted soon for fraud.

Wow. I used Monster Crayons for my wedding in August and now it sounds like I was one of the last brides who DIDN’T have problems with them! And I was a serious pain in the ass regarding editing, etc. As in, they sent me the first cut, I had them make changes, they sent me 25 copies of the new video, but I saw an error in one of the extra features and had them make ANOTHER 25 copies with the error corrected… and it all came out fine.

So sorry you had this trouble, I’m glad it turned out all right for you! Now I feel guilty for having recommended Monster Crayons to other brides!

Man, its kind of unbelieveable that they just closed their business like that. After so many people recommended their services too. What a headache!!! I’m so glad you got your money back!

I used Monster Crayons for my wedding in July and I had the same problems with my video. I received a video missing tons of footage, and when I asked them for some changes….they stopped responding to me. Until I received the email that they were closing down.

At that point, I just asked for my footage, I work in the wedding industry and could have another videographer do the editing. Sounds simple enough right? One less bride to deal with, I wasn’t asking for money…just my raw footage, and I would pay the FedEx shipping for them to send me, since I am in OC.

Not only have they not contacted me back, and blocked me from their myspace pages so I can’t send messages, and their lease at their office space is over. I contacted “7 on Your Side” no response from them. One of my clients, who is a lawyer, has now drafted all the paperwork for me to take them to small claims court. I also am working with my cc company to get a refund, but they are giving me problems because I paid them back in 2006 (when I signed my contract) and apparently, the normal claim period is for 6 months. (which does not work for the wedding industry)

So unfortunate to have to deal with this, especially when dealing with someone who has all your wedding footage in their possesion. They were a truly top-rated company when I hired them, and was a fan of their work way before my engagement, so we were excited to work with them. Now, I just get upset everytime I think about them and my video. :-(
