For me, our wedding has never been about one perfect day. Don’t get me wrong, I love shopping for a fabulous dress, crafting fun doodads, and throwing an awesome party. But as I mentioned in a previous post, I think of our wedding as one special day in a continuing process of love, partnership, and negotiation.

BUT that’s not to say that nothing will change on our wedding day. Because when Mr. HC and I marry, we almost instantaneously get all of the privileges and immunities that come with a legally recognized marriage. These benefits include:

  1. Estate planning benefits, including the ability to make financial and/or medical decision on my spouse’s behalf as a conservator and to get the various protections under probate law that are reserved for spouses.
  2. Tax benefits, including the ability to file joint tax income returns.
  3. Government benefits, including the ability to receive Social Security, Medicare, and disability benefits in our spouse’s name.
  4. Employment benefits, including the ability to take family leave to care for each other during an illness and to obtain insurance benefits through each other’s employer.
  5. Misc. legal benefits, including the ability to claim spousal privilege.

In fact, according to a 2004 Government Accounting Office report, there are over 1000 laws in which marital status is a factor — and that’s just in the federal law alone (imagine how many more state regulations deal with marriage)!

As we plan our wedding, I never lose sight of the fact that Mr. HC (who is white) and I (who am Chinese) couldn’t have gotten married in a number of states before 1967. Nor do I forget that my aunt and her partner can only be legally married in three states, and that even if they were to wed in one of those states, their marriage would still not be recognized by the federal government because of Defense of Marriage Act. Unfortunately, neither Obama/Biden nor McCain/Palin support legalization of same-sex marriage. Still, tomorrow’s election will still have important ramifications for equal access to marriage, especially for those with the opportunity to help defeat Prop. 8 in my home state of California.

If I had it my way, the state would get out of the marriage business entirely, and all of the above benefits would be disentangled from the status of marriage. But until the day that happens, there is no doubt in my mind that marriage is political. The state is the third partner in every marriage. Which is one of the many reasons why I’ll be in line bright and early at the polling station tomorrow and going home immediately after our engagement photo session to obsess over the poll results.

I completely agree with you Miss Cocoa! Also, immigration rights are not extended within civil unions!

Thus if you fall in love with your same sex partner and they’re a different nationality it will be VERY difficult to live together in the united states with out getting a different type of visa ( which is also hard to get)!

Please all you lovely Californians, no on prop 8! and Floridians no on prop 2!

I couldn’t agree with you more…My fiance is Chinese and I am white- I can’t even imagine not having the right to marry each other. I could go on and on about this issue forever, but I won’t! I am also from CA and will be voting first thing tomorrow!

I agree too Cocoa.

Honestly, two things government should stay out of: my uterus and my marriage. I am marrying a Taiwanese man- and that would have been illegal not so long ago.

Love between two people is not just about the body- it’s about the mind and soul.

You know how they run ads on this website that rotate??? Did you guys notice there is an ad flashing around with Palin/McCain and their ‘Yes on Prop 8″ stance?
I got the jitters.
What did you guys think when you saw the ad on this website? Do you think there should be political ads on this website- even though we talk about politics among the posts?

Great post, Miss HC. I’m in New Jersey but I’ll be thinking about California and Florida tomorrow and hoping for a good outcome for same-sex couples and their families!

Thanks for posting this Miss HC! I am in California and can’t wait to vote for Equality tomorrow. I try to always remember that not so long ago it was illegal to marry outside your race. I am SO thankful that it was overturned because my half Chinese half Irish wonderful fiance may have never been.

Sparkles-I saw the Prop 8 ad as well and got sick to my stomach. I have never seen a political ad on Weddingbee prior to this and it makes me wonder…

go Loving v. VA :) thanks for posting this and for recognizing the important aspects of marriage that go beyond the festivities and traditions of the wedding day. I voted early & will be working as a poll watcher tomorrow — I’m looking forward to a day (hopefully not too far off in the future!) when everyone recognizes that no one should limit the right of others to marry and that the decision two individuals make to get hitched doesn’t affect anyone except those two individuals, least of all the institution as a whole.

Thanks for the support, everyone. I’m glad to be able to talk about the political ramifications of marriage; I know many people expect a “wedding site” just to be about dresses and flowers and favors, but how can we ignore the most important aspect of marriage — the right to wed itself?! But for those who want dresses and flowers and favors, I’ll be back to posting about that later this week after I chew off all my finger nails waiting for the results of this election.

@Sparkles and @PrettyKitty: The ads are generated by Google, and Mr. Bee and BilBee have been working hard to filter them.

Way to go Miss H.C.! Everyone deserves the freedom to marry the person that they love, regardless of race, gender, or sexual orientation. With all of us so happy about our upcoming weddings, we must remember to take action on behalf of everyone who can’t legally marry. Thanks for posting on this.

Oh thanks for clarifying. That makes me feel better- I have already seen the ads about six times- *if* I am paying attention. They show up with pictures of the presidential candidates, then it flashes to ’sample ballot’ measures for the Prop 8. And Pretty Kitty- yes it made me wonder too…

Thanks for posting, Ms. HC. As a recently married (two months!) member of a heterosexual couple, I cannot imagine the indignity and injustice inherent in the removal of the right to marry - for anyone, straight or gay. I applaud you, and WeddingBee, for posting a note about the importance of marriage for ALL people.
