All You Need is Love, Part 2

Many of you posted touching, personal comments on my last post about same-sex marriage in California. Us Tacos sympathized with our LGBT homies near and far; to step back on the soapbox, we thought it was incredibly unfair that we could easily walk into City Hall and get a marriage license, but other committed couples could not.

California finally agreed! Proposition 8, a ballot measure banning same-sex marriage in California, passed in 2008. It was ruled unconstitutional by a U.S. District Court on August 4; it’s likely to get appealed all the way to the federal Supreme Court. Nonetheless, some legal peeps say same-sex couples could apply for marriage licenses as early as August 5.

Not every committed couple, gay or straight, wants to get married, of course.

But we’re thrilled that everyone really means everyone, for now. Thanks, California, for a really awesome wedding present. A good quote from the ruling as we head into our own nuptials:

“California’s obligation is to treat its citizens equally, not to mandate [its] own moral code.”

All you need is love! (doo do do do do)…

I was so happy to see today’s California Supreme Court ruling. Here in Tennessee, our state constitution actually mandates that marriage is only between a man and a woman and it specifically mandates that it does not recognize same sex marriage licenses, even from states where it is legal.

I work in policy and I strongly hold the position that “marriage” is a religious institution, not a government institution. I think the government should get out of marriage all together, and just grant *everyone* civil unions. Then, if a couple wants a “marriage,” they should turn to their respective institution.

But that’s just me and I don’t see that happen any time soon. I would just like to see people treated equally under the law (I mean, don’t we have a national Equal Protection Act?)

Oh, and the correction hasn’t made it yet to the ‘bee, but the ruling came from a U.S. District Court. Not the CA Supreme Court.

@AllynK43: You might be on to something. Sort of an opt-in arrangement rather than opt-out, with regard to the “marriage” designation.

I really hope this becomes a Supreme Court issue that finally puts this whole argument to rest. Love is love is love is love.

@Miss Taco:

It’s a very libertarian argument, what can I say. If I were in charge (and who doesn’t have a view of what they would do if they were in charge), I would couples to have a legalized union, with all of the benefits we currently afford married couples (hospital visitation, 401K transferrability, etc) and make it just as difficult to get out of as marriage so that people don’t opt in with their buddies to take advantage of the system. Pretty much exactly what some states are doing with same sex civil unions, except give it to everyone.

I hope this is one more nail in the coffin for inequality. As you said, not everyone wants to marry, but those who wish to should not be denied that right. Very happy!

Unfortunately, it’s already being appealed and even though it’s been overturned same sex couples still can’t run out and get married tomorrow.

But it’s still a really important step in this process, so go California!!

You’re an awesome ally for marriage equality Taco- I can’t believe you got this up so quick! You rock! I’ve been randomly tearing up ever since the ruling came down, it’s just so huge. And so awesome. Although the stay will probably prevent our September wedding from being the legal deal, you better bet we’ll be at the courthouse the second they start handing out licenses! Yay Judge Walker! Yay California!
