The Last Immigration Post

of 2011! Ha, have I taught you nothing? This is a process that never ends, it goes on and on my friends…

We’re about to remove the conditions on Mr. D’s provisional green card/permanent resident card. That’s right, we’re in a provisional marriage. Our learner’s permit of matrimony, if you will. Basically, to ensure that you’re not in a sham marriage (and I assume, to collect further revenue) after you receive the K-1 (fiance visa), then after you are married and complete the adjustment of status you receive a provisional green card—valid for 2 years from receiving the card. In our case this is January 2010, so when the government refers to anniversaries… they mean when you received your card—not your wedding anniversary.

You can apply for your 10 year card as soon as 90 days before your expiry date. For the past year or so, I’ve been having flashbacks to our engagement year. Moments such as, “oh, we should save a holiday card to send to the government,” or “don’t forget a picture of the two of us, we need evidence!”  If you don’t submit the forms, evidence of your relationship and $590… you get deported. So obviously this needs to be completed.

It’s a stressful situation for so many reasons, but it’s also a strange position to find yourself in: trying to view your relationship as an outsider, making sure you look like a real couple, proving to someone you’ll never meet that you are a couple in a real marriage.

I’ll be collecting the financial statements saying our bank accounts are intertwined, and plane tickets to show we go places together—because I have to. But I hate this process, I hate that it makes me feel that the burden of proof is on us, that it costs so much money that it is never ending.

I hate that I have to try and and plan our vacation before December 31, 2011—because if we don’t receive something from the government saying that Mr. D can travel, we’ll be on the lower 48 lockdown and unable to leave (really it’s the return part) to the USA. I hate that I have to plan and save for fees I’ve already paid (do they really think his biometrics/fingerprints have changed in 2 years?). I hate that I have to go through all this while watching other married friends never worry about such things.

We’ve sent the paperwork to Vermont (our filing service center) and have received the receipt and his appointment for re-fingerprinting. After that, we wait for the next instructions from the government.

Ugh, I’m so sorry you guys still have to deal with this. I honestly can’t imagine having to prove yourself over and over again (not to mention paying all that money) for something that should be so simple.. aka your love and your marriage. You guys are SO great together and anyone can see that - dumb, dumb government. I wish you continuing luck, my friend! <3

I have just gone through this, I filed at the beginning of August, and while I got the appointment for biometrics quite soon, my case is still in review. Did he get a receipt that says that the GC is extended for another year while they review? My GC expires tomorrow, however I have that letter and I’m planning on using that for working and for our out of the country travel in a couple of weeks. But I know exactly how you feel, it’s hard to always be sure that everything is properly documented.

Oh man, I feel for you, Mrs. D! I can’t imagine going through all that you’ve gone through, and it’s unbelievable that you’re still dealing with all of this after all this time! Keep hanging in there–you’re a strong woman!

Ugh, this sounds super frustrating. As annoyed as I am with my name-changing process, this paperwork all seems so ridiculous and excessive. It really is annoying that the burden of proof seems to be on you. Sigh. Stick with it, D!

Yeah, we are about three months away from this process. But then one more year and he can get citizenship - never to deal with this mess again!

Oh, I feel ya. It really does never seem to end. We have just heard that Mr E’s FBI clearance report is on its way, so we can FINALLY make progress with his NZ residency…and that, in turn, will make it easier (i hope!) to apply for my green card after 6 months. All this red tape is so frustrating! And I get totally jealous of my other married friends who have no clue what this stress is like. One step at a time, I guess….hang in there. We’re rooting for you guys.

It is so frustrating - I am just at the beginning process of this process- just got my initial fingerprinting done. Super stressful though! The way I try to look at it is that this is ‘just one of those things we have to do’ but I try to not let it be too big a part of our lives, I don’t want to let worrying about this take away from our wedding planning etc. Best of luck with the rest of your journey on this, it is a process but it will end.

Yeah the process is a pain in the ass, but it’s to deter sham marriages. But if you are in a legit marriage, it’s pretty straight forward process to demonstrate that you are indee in a bonafide marriage. You must file within 90 days before the expiration and if you provide them sufficient info your hubby 10 years GC will be in the mail without having to attend an interview. Good luck!

I am in shock, disbelief, etc. over your posts on this and the process you are forced to go through. To have to prove you are a legit couple is so frustrating when you are so in love and just want to live your normal life! You are providing amazing information to those that will follow in your shoes. I wish you the best of luck and hope the remaining steps are smooth and easy.

@Paola: yup! we have the receipt and a commentor on my personal blog said most people on VJ are saying it’s taking six months for Vermont filing. @historienne: @Mrs. Jaguar: I know right? January 2013 we can apply for his citizenship - but then August 2013 we can apply to move to the UK… and then start the process over there… yuck!

@Mrs. Jaguar: Lol, it does! Although the UK visa process isn’t easy-easy and is supposed to get harder after this April for family immigration.

It looks like ILE is going away, which isn’t good news for D’Orsay, since she would qualify for it after 4 years of marriage as the rules stand now. And they’re planning to up the wait for ILR to 5 years! It’s really not good.
