FOR THE ECO HONEYMOON GIVEAWAY
NO PURCHASE NECESSARY TO ENTER OR WIN. CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES.
By entering or participating in the Portovert and Weddingbee BeeGreen Honeymoon Giveaway Contest of March 2008 (the “Contest”) you agree to all of the following rules:
How to Enter. No purchase is necessary to enter the Contest. Enter the Contest on-line by emailing beegreenchallenge@gmail.com and include a picture of your green project or idea, your name, telephone number, age and wedding date. Any error or omission in the information shall void the entry. Limit one entry per person. If multiple entries are received from any person, only one entry will qualify for the random drawing. By participating, all entrants agree to abide by these Official Rules.
Eligibility. The contest is open to legal residents of the United States (excluding any states in which the contest is illegal, or in which registration of the contest or sponsor would be required) who are 18 years of age or older, and who are currently engaged. Proof of age may be required. Employees of the contest sponsor, Portovert, LLC (“Portovert”), Busy Busy Bee Blogs, LLC (“Weddingbee”), and its affiliates, and employees and affiliates of any prize supplier, and members of such employees’ immediate families or households, are ineligible to participate in this Contest.
Prize Deadlines. All entries for the Contest must be received on or before midnight (Eastern Time) on March 31, 2008. Winners will be selected from a random drawing scheduled to be held the day after the deadline.
Winner Selection and Notification. The odds of winning are dependent upon the number of eligible entries received. Winners will be selected from all eligible entries received. Any attempted second entry shall be discarded, and the entrant may be disqualified from the Contest. All drawings will be conducted under the supervision of Portovert and Weddingbee. The decisions of Portovert and Weddinbee are final and binding in all matters relating to this Contest. Entries are collectively the property of Portovert and Weddingbee and will not be returned. Entrants need not be present at the drawing to win a prize. Winners will be notified by phone or e-mail at the e-mail address or telephone number supplied by the entrant. If a winner cannot be reached or has not claimed the prize within fourteen (14) days, commencing on the day of first notification, or if an entrant is found to be ineligible, an alternate winner will be selected. If it is necessary to select an alternate winner, a second drawing will be held on April 15 (and thereafter as necessary). The same rules shall apply to any subsequent drawings.
Prizes. The Contest will award one (1) prize, consisting of lodging and meals for two persons for three days and two nights at the Rock Resorts of their choosing. The prize is provided by Rock Resorts, and Rock Resorts may impose restrictions and alter the terms of the prize. The lodging package is valid only from April 1, 2008 to March 31, 2009, and reservations must be made by the winner with Rock Resorts. There is no guarantee that lodging will be available on specific days during this period, and the winner should act promptly to contact Rock Resorts and make a reservation for available dates. The prize includes lodging (in one double occupancy room) and meals (excluding alcohol). The prize is for lodging and meals only, and all air and ground transportation costs are the sole responsibility of the winner.
General Conditions. This Contest is void where prohibited by law or where registration of the contest or sponsor would be required, and is subject to all applicable laws, including, without limitation, federal, state, and local laws and regulations. In the event of non-compliance by any winner with the Official Rules of this Contest, an alternate winner may be selected. Prizes are non-transferable and non-refundable. Return of any prize or prize notification as undeliverable will result in a disqualification of the winner and an alternate winner may be selected. All prizes will be awarded. Except where legally prohibited, acceptance of any prize constitutes permission for Portovert, Weddingbee and the prize supplier to independently use each winner’s name, photograph, likeness, voice, address (city and state) and testimonials, in internet, printed, broadcast or other media, whether now known or hereafter developed, in perpetuity, in any manner either of them deems appropriate in connection with promoting their respective businesses or this or any other Contest and/or promotion or prize sponsored by either of them, without further compensation to the winner (or the winner’s guest). The terms and conditions of use of the Portovert and Weddingbee website are incorporated herein, except when in direct conflict with these Official Rules.
Releases. By participating, entrants agree that Portovert, Weddingbee and those involved in the development, production (including prize suppliers), implementation and distribution of this Contest and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (hereinafter collectively called “Promoters”), shall not be liable for any claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to such entrant’s participation in this Contest, such entrant will indemnify and hold Promoters harmless from and against any and all such claims, including reasonable attorneys’ fees related thereto. All entrants further agree and consent by participating that all information submitted to Portovert and Weddingbee becomes the property of Portovert and Weddingbee and may be used by Portovert and Weddingbee and also shared with and used by the prize supplier (and this shall supersede any other privacy policies of Portovert and Weddingbee, solely for purposes of this contest). Promoters shall not be liable for entries that are delayed, lost, misdirected, misdelivered, incorrect or incomplete, and such entries will be not be eligible for this Contest. Promoters shall not be responsible for any technical malfunctions of any telephone network, computer on-line system, computer equipment or software; program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or electronic; or any combination thereof, including, without limitation, any injury or damage to the computer of any entrant or any other person related to or resulting from downloading any part of this Contest. Any person attempting to defraud or in any way tamper with this Contest will be ineligible for prizes and may be prosecuted to the full extent of the law. Portovert and Weddingbee reserve the right, in its sole discretion, to cancel or suspend this Contest should viruses, bugs or other causes beyond its control corrupt the proper administration or security of the Contest. Portovert and Weddinbee reserve the right to modify the rules of the Contest in any way or at any time, as long as reasonable notice is given. All taxes on any prize won are the sole responsibility of each winner, including, without limitation, any federal, state, or local taxes which may be deemed applicable in such winner’s jurisdiction of residence. This Contest shall be governed by the laws of the Commonwealth of Virginia, United States of America. By participating in this contest, entrants agree that the state and federal courts located in the Commonwealth of Virginia shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue for such litigation shall be only in the Circuit Court for the City of Richmond, Virginia or the United States District Court for the Eastern District of Virginia, Richmond Division.
Rules/Winners List. The winners name may be posted on both Weddingbee and Portovert’s website within fifteen (15) days of the drawing. To receive a copy of these Official Rules or the winner, send a self-addressed stamped envelope to: Portovert.com Contests- Winners List, 2465 Centreville Road, No. J17-223, Herndon, VA 20171. Specify “winners list” or “rules” on your request. WA and VT residents may omit return postage.
Affidavit. As a condition to eligibility for any prize, a winner shall execute and return an affidavit and release by which he or she represents and covenants (a) that he or she has read and understood these Official Rules; (b) that he or she will be bound by all of the provisions of these Official Rules; (c) that he or she will be solely responsible for all federal, state and local income and other taxes associated with the prize and for any insurance (if any) related to the receipt or use of the prize; (d) that he or she will be responsible for filing any necessary forms for tax purposes; (e) that the winner guarantees to Portovert and Weddingbee that any guest of winner who joins winner in utilizing the prize will be bound by these Official Rules to the same extent as the winner; and (f) that Portovert, Weddingbee and Rock Resorts shall have no liability for any use of any prize, and that he or she will indemnify and hold harmless Portovert, Weddingbee and Rock Resorts, their officers and directors, and their affiliates, subsidiaries, agencies and employees, from and against any liability (including reasonable attorneys’ fees) incurred by any of them as a result of or arising out of any breach of the foregoing representations or covenants.
Other Conditions. Decisions of Portovert and Weddingbee are final in all matters pertaining to the contest. In the event of any alleged ambiguity, conflict or discrepancy in these Official Rules, Portovert and Weddingbee’s collective interpretation of the Official Rules shall govern. Portovert and Weddingbee reserve the right to withdraw the contest or make changes at any time. Portovert and Weddingbee does not guarantee performance by Rock Resorts should Rock Resorts become bankrupt, insolvent or otherwise unable to perform its obligations or should breach any of its obligations to a winner, Portovert and Weddingbee shall have no responsibility. By submitting an entry to this Contest, an entrant acknowledges his or her agreement to the above Official Rules and restrictions.
